Sweepstakes Official Rules
How to enter:
NO PURCHASE NECESSARY TO ENTER OR WIN. If you open a new account (Checking, Savings, CD) or get a new consumer, home, or home equity loan, you will automatically receive one (1) entry into the Sweepstakes for each product. You do not need to fill out any additional forms, nor will any additional forms be sent to you. If you do not wish to receive automatic entry to the Sweepstakes, you must mail us at TSB Sweepstakes Promotion/Do Not Enter, Marketing Department, 3900 N. 10th Street, McAllen, TX 78501, or call us at (956) 971-5966, and instruct us not to enter you. In the case of joint accounts, the primary owner or applicant will receive the entry(ies).
To enter without obtaining or signing up for any of the products described above, or if you desire additional entries: Hand print your name, address, city, state, zip, daytime and evening phone numbers, and the words “TSB Sweepstakes Promotion” on a 3X5 card and mail it in a stamped #10 envelope to TSB Sweepstakes Promotion, Marketing Department, 3900 N. 10th Street, McAllen, TX 78501. Limit one (1) entry per postmarked stamped outer envelope. Each mail-in entry must be postmarked by April 14, 2008 and timely received to count as one (1) entry. There is no limit to the number of entries you can send. No photocopied, computer generated facsimiles, mechanically reproduced, or mass entries permitted. All entries become the property of Texas State Bank (‘Sponsor”) and will not be acknowledged or returned. Lost, late, misdirected, incomplete, illegible, or mutilated entries will be disqualified.
Sweepstakes Period:
The Sweepstakes period runs from 12:01am CST on January 14, 2008 until 11:59pm CST on April 14th, 2008.
Eligibility:
Sweepstakes is open to legal residents of Texas only, eighteen (18) years of age or older at the time of entry. Void in all other states of the U.S., U.S. overseas territories, possessions, commonwealths and military installations, foreign jurisdictions, and where prohibited or restricted by law. Sweepstakes may only be entered into from the United States (other than the jurisdictions excluded above), and entries originating from any other jurisdiction are not eligible for entry. Employees and agents of Texas State Bank, its advertising and promotional agencies and prize suppliers, and their respective subsidiaries and affiliates, and the immediate family members (spouses, parents, children, siblings and their respective spouses) or persons living in the same household as such individuals, are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Each eligible entry will be deemed to have been made by the individual named on the account as the primary owner, named on the consumer loan application as the primary applicant, named as the primary person signing up for or receiving a service, such as direct deposit or online banking, or named in the mail-in entry, as the case may be.
Prizes:
Grand Prize: One (1) randomly selected grand prize winner will be awarded a new 2008 Hummer H3 approximate retail value $31,000.00.
First Place Prizes: Five (5) randomly selected first place winners each will be awarded a pre-paid gas card in the amount of Two Hundred and 00/100 ($200.00) Dollars.
Odds of winning a prize depend on the number of eligible entries received.
Prize Restrictions:
All prizes will be awarded. Prizes are non-transferable, non-assignable, and non-exchangeable. Exact prize components are subject to change without notice. No substitutions, equivalents, or redemptions of any prize permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that the advertised prize (or any component thereof) is not available. Prize recipients will be required to provide a valid U.S. taxpayer identification number. Eligibility to receive a prize is conditioned upon Sponsor's determination that it has no obligation to backup withhold pursuant to Section 3406 of the Internal Revenue Code of 1986, as amended. Prize recipients are solely responsible for reporting and payment of all taxes associated with accepting a prize, including U.S. federal, state, local or foreign income, gift, sales and use, real property, personal property, and estate taxes. Sponsor shall have no responsibility for any taxes, fees, surcharges financing costs, closing costs, insurance or other amounts associated with receipt or ownership of any prize. There is no guarantee that the Internal Revenue Service or any state or local taxing authority will accept the stated value of any prize for the purpose of determining any tax that may be due from a recipient. Sponsor makes no representations or warranties concerning the appearance, safety or performance of any prize awarded, and Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prizes awarded.
Winner Selection and Notification:
Potential winners will be selected in a random drawing to be held on or about May 1, 2008 at the main office of Texas State Bank, 3900 N. 10th Street, McAllen, TX 78501, from among all eligible entries received. Potential winners will be notified within seven (7) days after drawing date by telephone, certified mail or overnight courier. Each potential winner may be required to execute an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited by law). Except where prohibited by law, if a potential winner does not return all such required documents within seven (7) days of the date of receipt of prize notification, or in the event that a prize or prize notification is returned as undeliverable or a potential winner cannot be contacted, the prize may be forfeited and an alternate winner selected by random drawing from all remaining eligible entries.
Release and Limitations of Liability:
By entering, all participants agree to (i) be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all matters relating to the Sweepstakes; and (ii) release, discharge, and hold harmless Texas State Bank, its parents, subsidiaries, affiliates, and their respective agents, representatives, successors, assigns, shareholders, officers and directors (collectively, “Releasees”) from and against any and all liability, claims, damages, costs or expense whatsoever arising from or relating to, in whole or in part, directly of indirectly, their participation in the Sweepstakes or the acceptance, use, misuse, or possession of any prize. All winners grant to Texas State Bank the right to print, publish, broadcast and use, in perpetuity, worldwide and in any media now known or hereafter developed, their name, address (city and state), likeness, biographical information, and any statements made by winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes, without notice or compensation, except where prohibited by law, in connection with the Sweepstakes, and upon request will provide consent to such use in writing. Participants agree that Releasees are not responsible for (i) any condition caused by events beyond the control of the Sponsor that cause the Sweepstakes to be disrupted or corrupted; or (ii) any computer, printing, typographical, human or other errors relating to or in connection with the Sweepstakes, including without limitation errors which may occur in the administration of the Sweepstakes, the announcement of the prizes, the processing of entries or in any Sweepstakes-related materials, or for entries/transactions that fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error. Without limiting the release and limitations of liability set forth above, and as a condition of entering the Sweepstakes, participant agrees that: (i) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, or consequential damages; and (ii) all claims or causes of action arising out of or relating to this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action. Sponsor reserves the right to modify prize award procedures at its discretion.
Miscellaneous
By entering the Sweepstakes, you agree to comply with all of the terms and conditions mentioned herein. Noncompliance with any entry procedure will result in disqualification. Furthermore, if there is any suspected evidence of tampering or corruption or if the Sweepstakes is compromised by any unauthorized human intervention or any other causes beyond the control of Texas State Bank, its parents, subsidiaries, or affiliates which corrupts or impairs the administration, security, or fairness of the Sweepstakes, Texas State Bank reserves the right to disqualify any entrant deemed responsible for such corruption, to suspend and/or terminate the Sweepstakes, and to select winners from the eligible entries received up to the time of such termination or suspension. If the Sweepstakes is terminated prior to the end of the Sweepstakes period, notice will be posted at Texas State Bank at 3900 N. 10th Street, McAllen, Texas 78501, and at Sponsor’s website or via other media used to promote the Sweepstakes.
